Gewinnspiel auf Instagram

1. Veranstalter des Gewinnspiels ist AQUA DOME – Tirol Therme Längenfeld GmbH & Co KG. Das Gewinnspiel läuft vom 11.02.2025, 16 Uhr bis zum 13.02.2025, 10 Uhr. Mit der Teilnahme am Gewinnspiel akzeptiert der Teilnehmer die nachfolgend genannten Teilnahmebedingungen. Für die Organisation, Abwicklung sowie Preisbereitstellung ist AQUA DOME – Tirol Therme Längenfeld GmbH & Co KG zuständig und verantwortlich. Dieses Gewinnspiel steht in keiner Verbindung zu Instagram und wird in keiner Weise von Instagram gesponsert, unterstützt oder organisiert.

2. Unter allen Kommentaren ermittelt AQUA DOME – Tirol Therme Längenfeld GmbH & Co KG nach Ablauf des Durchführungszeitraumes unter Ausschluss der Öffentlichkeit sowie ohne Beisein eines Notars per Zufallsprinzip den/die GewinnerIn. Kommentare, die gegen die Instagram-Richtlinien, österreichisches Recht, unsere Netiquette und/oder gegen Rechte Dritter verstoßen, werden nach Kenntnisnahme ohne Ankündigung entfernt. Der Teilnehmer ist damit von der Verlosung ausgeschlossen.

3. Der Gewinner wird per Kommentar und/oder Direktnachricht am Donnerstag, 13.02.2025 verständigt. Die Inanspruchnahme des Gewinns erfolgt durch schriftliche Kontaktaufnahme unter Angabe der vollständigen, für die Durchführung des Gewinnspiels erforderlichen, Kontaktdaten. Auf Aufforderung ist eine Ausweiskopie zu übermitteln.

4. Der Rechtsweg ist ausgeschlossen. Eine Barauszahlung der Gewinne ist nicht möglich. Gewinnansprüche sind nicht auf andere Personen übertragbar. Die Gewinner von Eintrittskarten sind nicht zum Umtausch, zum Verkauf oder zur Weitergabe der gewonnenen Eintrittskarten berechtigt. Der Gewinn wird am 14.02.2025 vor Ort persönlich an den Gewinner übermittelt und ist ausschließlich am 14.02.2024 einlösbar. Der Gewinner erklärt sich damit einverstanden, die Preisbereitstellung an diesem Tag in Begleitung des AQUA DOME Social Media Teams durch eine Live-Story-Begleitung auf seinem persönlichen Instagram-Account zu dokumentieren. Die finalen Inhalte werden in Abstimmung mit dem Social Media Team freigegeben, und der offizielle AQUA DOME Instagram-Account ist dabei zu markieren. Der Gewinner erklärt sich einverstanden, dass die erstellten Inhalte in Abstimmung mit dem AQUA DOME Social Media Team veröffentlicht werden. Die genauen Nutzungsrechte werden vor Ort in einer separaten Einverständniserklärung geregelt.

5. Teilnahmeberechtigt sind Personen, die bei der Teilnahme mindestens 18 Jahre alt sind. Nicht teilnahmeberechtigt sind Mitarbeiter, Bevollmächtigte, Rechtsnachfolger und Beauftragte von AQUA DOME – Tirol Therme Längenfeld GmbH & Co KG, involvierte Agenturen, sowie deren Angehörige. Bei einem Verstoß gegen diese Teilnahmebedingungen behält sich AQUA DOME – Tirol Therme Längenfeld GmbH & Co KG das Recht vor, Personen vom Gewinnspiel auszuschließen.

6. Das Gewinnspiel unterliegt österreichischem Recht. AQUA DOME – Tirol Therme Längenfeld GmbH & Co KG behält sich vor, das Gewinnspiel aus wichtigen Gründen zu jedem Zeitpunkt abzubrechen. Ein Abbruch aus wichtigem Grund kann insbesondere dann erfolgen, wenn eine ordnungsgemäße Durchführung aus technischen oder rechtlichen Gründen nicht mehr gewährleistet werden kann. Bei einem Abbruch bestehen keinerlei Ansprüche gegenüber AQUA DOME – Tirol Therme Längenfeld GmbH & Co KG.

7. Soweit im Einzelfall nur die männliche oder weibliche Form bei Ausdrücken gewählt wurde, wird ausdrücklich darauf hingewiesen, dass diese geschlechtsneutral zu verstehen sind und sich sowohl auf männliche als auch auf weibliche Teilnehmer beziehen.

Datenschutzhinweis

1. Soweit im Rahmen des Gewinnspiels personenbezogene Daten von Teilnehmern erfasst werden, werden diese von AQUA DOME – Tirol Therme Längenfeld GmbH & Co KG ausschließlich zum Zwecke der Durchführung des Gewinnspiels erhoben, verarbeitet und genutzt sowie nach Beendigung des Gewinnspiels nach Maßgabe der nachstehenden Bestimmungen gelöscht. Personenbezogene Daten sind alle Daten, die Einzelangaben über persönliche oder sachliche Verhältnisse enthalten, wie etwa Name, Anrede/Titel, Adresse, E-Mail-Adresse, Benutzername auf Instagram, Telefonnummer, Sprache. Mit Teilnahme an dem Gewinnspiel erklärt sich der Teilnehmer mit der Verarbeitung dieser Daten einverstanden.

2. Die Verarbeitung der personenbezogenen Daten des Teilnehmers erfolgt auf Basis von Art 6 Abs 1 lit b Datenschutz-Grundverordnung (DSGVO) (Vertragserfüllung). AQUA DOME – Tirol Therme Längenfeld GmbH & Co KG versichert, dass die personenbezogenen Daten vertraulich und entsprechend den datenschutzrechtlichen Bestimmungen verwendet werden.

3. Die Daten, welche zur Abwicklung und Dokumentation des jeweiligen Gewinnspieles erforderlich sind, werden für die Dauer der Gewinnspielabwicklung gespeichert, sofern nicht auf Grund gesetzlicher Bestimmungen, oder zur Abwehr oder Geltendmachung von Ansprüchen eine Pflicht oder Notwendigkeit zur längeren Speicherung der Daten (insbesondere auf Grund abgabenrechtlicher Vorschriften besteht). Der Teilnehmer kann diese Zustimmung jederzeit per datenschutz@aqua-dome.at oder postalisch an AQUA DOME – Tirol Therme Längenfeld GmbH & Co KG, Oberlängenfeld 140, A – 6444 Längenfeld, widerrufen.

4. Für die Korrektheit und Vollständigkeit seiner abgeschickten Daten ist der Teilnehmer selbst verantwortlich. Ohne Bereitstellung der notwendigen Daten ist eine Abwicklung und Dokumentation des Gewinnspiels nicht möglich. Die vollständige Datenschutzmitteilung ist über die Website abrufbar und speicherbar.

Jeder Teilnehmer hat ein Recht auf Auskunft über die von ihm gespeicherten personenbezogenen Daten, auf Berichtigung, Löschung, Einschränkung der Verarbeitung, sowie auf Datenübertragbarkeit. Diese Rechte können die Teilnehmer jederzeit per E-Mail an datenschutz@aqua-dome.at oder postalisch an AQUA DOME – Tirol Therme Längenfeld GmbH & Co KG, Oberlängenfeld 140, A – 6444 Längenfeld, geltend machen. Darüber hinaus besteht ein Recht auf Beschwerde an die Datenschutzbehörde.

 

Conditions of participation
Competition on Instagram

1. The organizer of the competition is AQUA DOME – Tirol Therme Längenfeld GmbH & Co KG. The competition runs from 02/11/2025, 4 p.m. to 02/13/2025, 10 a.m. By participating in the competition, the participant accepts the following conditions of participation. AQUA DOME – Tirol Therme Längenfeld GmbH & Co KG is responsible for the organization, processing and pricing. This competition is not related to Instagram and is in no way sponsored, supported or organized by Instagram.

2. After 02/13/2025, 10 a.m., AQUA DOME – Tirol Therme Längenfeld GmbH & Co KG randomly determines the winner after the end of the competition, without the presence of a notary. Comments that violate the Instagram guidelines, Austrian law, our netiquette and / or the rights of third parties will be removed after notice without notice. The participant is therefore excluded from the competition.

3. The winner will be notified by comment and / or direct message on Thursday, 02/13/2025. The prize will be claimed by contacting us in writing, stating the full contact details required to run the competition. A copy of your ID must be provided on request.

4. The judges‘ decision is final. Cash payment of the prize is not possible. Claims to winnings are not transferable to other persons. The ticket winners are not entitled to exchange, sell or pass on the tickets they have won. The prize will be handed over to the winner in person on-site. The winner agrees to document the prize handover on this day through a live story on their personal Instagram account in collaboration with the AQUA DOME social media team. The final content will be approved in coordination with the social media team, and the official AQUA DOME Instagram account must be tagged. The winner also agrees that the created content may be published in coordination with the AQUA DOME social media team. The exact usage rights will be regulated separately in a consent form on-site.

5. Persons who are at least 18 years of age are eligible to participate. Employees, authorized representatives, legal successors and agents of AQUA DOME – Tirol Therme Längenfeld GmbH & Co KG, agencies involved and their relatives are not eligible to participate. In the event of a violation of these terms and conditions, AQUA DOME – Tirol Therme Längenfeld GmbH & Co KG reserves the right to exclude people from the competition.

6. The competition is subject to Austrian law. AQUA DOME – Tirol Therme Längenfeld GmbH & Co KG reserves the right to cancel the competition at any time for important reasons. Termination for an important reason can take place in particular if proper implementation can no longer be guaranteed for technical or legal reasons.
